Legal & Compliance
Policies and terms.
These policies have not yet been reviewed by an attorney. They are grounded in real, current federal and state rules — the FDA’s intended-use doctrine, the FTC Mail/Internet/Telephone Order Merchandise Rule (16 C.F.R. Part 435), CAN-SPAM, and state return-policy statutes — and they state Tyde Labs’ actual practices. But they should be reviewed by qualified counsel before ordering opens, and this notice will be removed when that review is complete.
Terms of Sale
DOC-03 · §1 TERMSThese Terms govern your use of tydelab.com and any order placed through it. By using this site or placing an order, you agree to these Terms, the Research Use Only & Regulatory Disclaimer, and the Eligibility, Age & Researcher Attestation below. These Terms are between you and Tyde Labs Corporation, a New Jersey corporation(“Tyde Labs,” “we,” “us”).
What these Terms cover
These Terms apply to browsing this site, creating an account, and placing an order. They incorporate every other policy on this page by reference. If you do not agree to them, do not use the site or place an order.
Your account
You are responsible for the accuracy of the information on your account and for keeping your credentials confidential. You are responsible for activity that occurs under your account. Tell us promptly if you believe your account has been accessed without your authorization, and we will help you secure it. Tyde Labs may suspend or close an account that breaches these Terms, that we reasonably believe was created with false representations, or that is used to place orders inconsistent with Research Use Only.
Order acceptance
An order is an offer to purchase, not an acceptance. Tyde may decline or cancel any order for any reason, including suspected ineligibility under Eligibility, pricing or listing errors, suspected fraud, or inability to verify the order. If an order is declined or cancelled after payment is captured, the payment is refunded in full.
Pricing
Prices are stated in U.S. dollars unless otherwise noted and may change at any time before an order is placed. A pricing error identified after an order is placed does not obligate Tyde to honor the incorrect price; in that case the order is cancelled and refunded, or you are offered the corrected price before the order is fulfilled.
Payment
Orders are paid in USDC on the Base network — a stablecoin transfer you send from your own wallet. Payment is made directly by you, from a wallet you control, to an address Tyde Labs controls. No card network, bank, or payment processor is a party to the transaction, and Tyde Labs does not hold, exchange, or transmit funds on anyone else’s behalf. An order is accepted when the transfer is confirmed on-chain for the exact amount stated on your order page — not when the order is placed, and not when a transfer is broadcast.
Restrictions on use of this site
You agree not to:
- Misrepresent your identity, age, or the purpose of your purchase.
- Resell, relabel, or redistribute any Tyde product as anything other than a research material in its original, unopened packaging.
- Use this site to source materials for human or veterinary consumption, administration, or any diagnostic or therapeutic purpose.
- Attempt to circumvent the eligibility attestation required at checkout.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect.
Eligibility, Age & Researcher Attestation
DOC-03 · §2 ELIGIBILITYTyde sells laboratory research materials on a self-attestation basis — we do not require institutional verification, but the representations below are real terms of the sale, not a formality.
By placing an order, you represent and warrant that:
- You are at least 21 years of age.
- You are purchasing for legitimate laboratory, analytical, research, or industrial purposes — not for personal, human, or veterinary consumption, administration, or use.
- You will handle, store, and dispose of any product in accordance with applicable safety practices and the product’s Safety Data Sheet, and in compliance with the laws of your jurisdiction.
- You have independently confirmed that purchasing, possessing, and using the specific product(s) you are ordering is lawful in your jurisdiction — see Research Use Only & Regulatory Disclaimer.
A false attestation is a material breach of these Terms and may result in order cancellation, account termination, and — where required by law — a report to the applicable authorities.
Research Use Only & Regulatory Disclaimer
DOC-03 · §3 RUOTyde products are laboratory research chemicals, sold and marketed strictly for in-vitro laboratory research, analytical reference, or manufacturing use. They are not for human or veterinary use, not for personal use, not for diagnostic or therapeutic use, and not for use in food, drugs, cosmetics, or household chemicals. They have not been evaluated by the U.S. Food and Drug Administration and are not intended to diagnose, treat, cure, or prevent any disease.
What “Research Use Only” means here — and what it doesn’t
This designation reflects the actual, sole intended use of these products as marketed by Tyde. It is not, by itself, a regulatory status the FDA has granted this product category: the FDA’s formal “Research Use Only” labeling framework applies to in-vitro diagnostic devices, not to research chemicals like these. Tyde uses the phrase in the sense adopted across the research-chemical supply industry — an affirmative, binding statement of intended use — not as a claimed exemption.
Under FDA’s intended-use doctrine, a label statement does not control by itself: regulators look at the totality of marketing, packaging, product naming, site content, and the circumstances of a sale to determine a product’s true intended use. Accordingly, no statement anywhere on this site, in a product description, in customer communications, or in any associated content is intended to suggest human consumption, therapeutic benefit, or diagnostic or medical application — and none should be read that way. If you believe any content on this site reads otherwise, contact us (see Contact) so it can be corrected.
No claims, no guidance
Tyde does not make, and does not permit sellers or listings on this site to make, any health, therapeutic, anti-aging, weight-loss, performance, or disease-related claim about any product. Tyde does not provide dosing, administration, or usage instructions for human or animal consumption, under any circumstances, in any channel. Product descriptions are limited to specification: identity, purity, analytical method, physical form, and available documentation.
Jurisdictional responsibility
Some research chemicals may be subject to additional state or federal controlled-substance or controlled-substance-analogue laws depending on their chemical structure and your jurisdiction. Tyde does not represent that any product is legal to purchase, possess, or use in every U.S. state or country. You are solely responsible for confirming the legality of any product under the laws of your own jurisdiction before ordering.
Handling & safety
Consult the applicable Safety Data Sheet and follow standard laboratory safety practice for any product before handling it. Tyde is not a source of safety, handling, or health guidance beyond the documentation provided with a given material.
User-generated content
Tyde does not endorse, verify, or substantiate any statement about a product’s effects appearing in reviews, forums, or other user-generated or third-party content, and reserves the right to remove any such content.
Shipping & Order Fulfillment
DOC-03 · §4 SHIPPINGOrdering is not currently open. This policy will already be in effect the moment it opens.
Processing & ship time
Once ordering opens, an estimated processing and ship window will be stated at checkout and on your order confirmation. If no window is stated for a given order, Tyde Labs will ship within 30days of a properly completed order, consistent with the FTC’s Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435).
What ships, and how
Orders ship from within the United States. Materials that require it are shipped cold, with appropriate insulation and cooling for the transit time; the packaging is designed to hold temperature through the carrier’s stated delivery window, not indefinitely, so unpack and store items promptly on arrival per the product documentation.
Tracking & delivery
A tracking number is emailed when your order ships. Risk of loss passes on delivery to the address you provided. If tracking does not show delivery, contact us — an order that never arrives is covered under Returns, not treated as your loss.
Address accuracy
You are responsible for the accuracy of the shipping address you enter. If a package is returned to us as undeliverable because of an incorrect address, we will contact you and can reship at your cost, or refund the order less the original outbound shipping.
Delays
If Tyde cannot meet the stated (or default) shipping window, you will be notified before that deadline with either a revised ship date or a statement that a date cannot yet be given, and offered the choice to consent to the delay or cancel for a prompt refund. Delays of 30 days or less are treated as accepted unless you tell us otherwise before shipment; delays longer than 30 days, or of indefinite length, result in automatic cancellation and refund unless you affirmatively ask us to keep the order open.
Cancelling an order
You may cancel or modify an order at any time before it enters fulfillment, free of charge. Once an order has shipped, it can no longer be cancelled and is instead governed by Returns & Refunds.
International shipping
Tyde does not currently ship outside the United States. Any future international shipping will be announced with its own terms, including buyer responsibility for import compliance, duties, and local legality under Research Use Only & Regulatory Disclaimer.
Returns, Refunds & Order Issues
DOC-03 · §5 RETURNSOpened or used products
A product cannot be returned once its tamper-evident seal has been broken. This is consistent with standard practice across the laboratory-chemical supply industry: an opened chemical container cannot be re-certified as unopened or uncontaminated, so it cannot be safely resold. This is a scientific and safety-driven policy, not an arbitrary restriction.
Unopened products
Unopened, unused products with an intact tamper-evident seal, in their original packaging, may be returned within 30 days of delivery. Return shipping is the buyer’s responsibility unless the return is due to a Tyde Labs error under the exceptions below. No restocking fee is charged on an eligible return.
To start a return, contact us with your order number before shipping anything back, so we can confirm eligibility and give you a return address. Returns sent without contacting us first can’t be tracked to your order and may not be refundable.
Exceptions — always eligible for a remedy
Regardless of the above, and regardless of whether the seal is intact, you are entitled to a replacement or full refund if:
- The item you received was defective or did not match its published specification.
- You received the wrong item.
- The item arrived damaged in transit.
- The order never arrived, and tracking does not show delivery.
To use one of these exceptions, contact us within 7 days of delivery with your order number and, where applicable, photos of the item and its packaging. You will not be asked to return a damaged or hazardous item at your own risk — we will tell you whether to return, retain, or safely dispose of it.
Orders cancelled by Tyde Labs
If we cancel an order — for a listing error, an eligibility concern, an inability to verify the order, or because we cannot fulfill it — you are refunded in full, and no return, fee, or condition applies.
How refunds are paid
Refunds under this policy are paid in the same asset, on the same network, to an address you give us in writing. Because a crypto payment cannot be reversed, a refund is a new transfer we make by hand once the return is approved. We refund the amount we received, less the network fee required to send it back. We do not refund to a card, a bank account, or any address other than the one you confirm with us.
Refund timing
Once a refund is approved, Tyde Labs sends it within two business days of receiving and confirming your refund address. The transfer is made on the same network and in the same asset as your payment. Network confirmation time is outside Tyde Labs’ control; the transaction hash is provided on request so you can see it yourself.
This policy is posted so it applies
Several states require an online retailer to conspicuously post its return policy, and treat the absence of a posted policy as triggering a default consumer-favorable refund right. This policy is that posted policy — it is linked from the site footer, the product page, and checkout, and applies to every order.
Privacy Policy
DOC-03 · §6 PRIVACYWhat we collect
- Contact & account information — email address, and password (stored encrypted). An account is required to place an order; browsing does not need one.
- Order information — items purchased, shipping address, and order history, once ordering is open.
- Payment information — handled directly by our payment processor; Tyde does not receive or store full card numbers.
- Usage information — basic site analytics (pages viewed, general device/browser information) used to operate and improve the site.
Why we collect it
To operate your account and fulfill orders, to communicate with you about an order or request, to maintain and secure the site, to comply with legal obligations, and — only with your opt-in — to send product or launch updates.
Do we sell your information?
No. Tyde Labs does not sell or share your personal information for cross-context behavioral advertising, as those terms are defined under California law. We have never done so. If that ever changes, this section will be updated and a clear opt-out will be provided before any such disclosure occurs.
Who we share it with
We share personal information only with the service providers needed to run the business, and only the minimum each one needs:
- Payment processing — to authorize and settle your payment. Card details go directly to the processor; Tyde Labs never receives or stores full card numbers.
- Shipping carriers — name and delivery address, to deliver your order.
- Email delivery — your address, to send account and order email.
- Hosting and database infrastructure — which stores site and order data on our behalf.
These providers are permitted to use your information only to perform that service for us. We do not give them permission to use it for their own marketing. We may also disclose information where required by law, to respond to valid legal process, or to protect the rights and safety of Tyde Labs, our customers, or the public — and, if the business is ever sold or reorganized, to the successor, subject to this same policy.
Cookies
We use cookies that are necessary for the site to function — keeping you signed in and remembering your cart between pages. We do not use advertising or cross-site tracking cookies. You can block cookies in your browser, but sign-in and cart will stop working.
Your rights
Regardless of where you live, you can ask us to tell you what personal information we hold about you, correct it, or delete it, and you can opt out of any marketing communication at any time. See Contactto exercise any of these rights. If you are a California resident, these rights are also available to you under the California Consumer Privacy Act, regardless of whether Tyde meets that law’s applicability thresholds — we apply these principles as a matter of policy either way.
Marketing email
Tyde is not sending marketing email yet. Addresses given to the launch list are stored and nothing else; no campaign has been sent, and none will be until the commitments below can be met in full. If you joined the list and want your address removed before then, email privacy@tydelab.com and it will be deleted.
When marketing email does begin, every message will identify its sender accurately, include a valid postal address, and carry a one-step unsubscribe link that requires no login or fee and stays functional well past 30 days. Opt-out requests will be honored within 10 business days, and an address that opts out is never sold, rented, or transferred. Transactional email — order confirmations, shipping notices, account notices — is separate from marketing email and is not an opt-out communication while you have an active order or account.
Children’s privacy
Tyde is not directed to children. Consistent with the 21+ purchase requirement in Eligibility, we do not knowingly collect personal information from anyone under 21. If you believe a minor’s information was collected, see Contact and it will be deleted.
Data retention & security
We retain account and order information for as long as your account is active and as needed to meet legal, tax, and accounting obligations. We use industry-standard technical and administrative safeguards to protect your information, including encrypted storage of credentials and restricted internal access.
Intellectual Property
DOC-03 · §7 IPThe Tyde name, logo, and all site content — copy, design, and imagery — are the property of Tyde or its licensors and may not be copied or reused without permission. Any Certificate of Analysis provided remains the property of the testing laboratory that issued it, and is supplied for reference in connection with your order.
Copyright complaints (DMCA)
If you believe material on this site infringes your copyright, send a notice to support@tydelab.comwith the subject line “DMCA”. To be actionable under 17 U.S.C. §512(c)(3), your notice needs to include: your physical or electronic signature; identification of the work you say is infringed; identification of the material you want removed and where it appears on this site; your contact details; a statement that you believe in good faith the use is not authorized by the copyright owner, its agent, or the law; and a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for them.
We remove or disable material that is the subject of a valid notice, and we will pass the notice to whoever supplied the material so they can respond with a counter-notice. Repeat infringers lose access to any feature that lets them submit content.
Accessibility
DOC-03 · §8 ACCESSTyde Labs aims to meet WCAG 2.1 Level AA. That target is not decorative: this site is built with real semantic elements rather than styled divs, so it is operable by keyboard alone, every form control has a programmatically associated label, status changes are announced to assistive technology, a “skip to content” link bypasses the navigation, and status is never communicated by color alone.
Accessibility is treated the same way as a broken link or a wrong price — a defect to fix, not a preference to weigh. If any part of this site is difficult or impossible for you to use, email support@tydelab.com and describe what you were trying to do and what got in the way, including the assistive technology and browser you use if you know them. We aim to reply within one business day, and we will tell you plainly whether we can fix it and by when.
If something is unusable for you right now and you need it done another way, say so in the same email. We will complete the task with you directly — placing an order, retrieving a certificate of analysis, or answering a specification question — rather than making you wait for a fix.
Limitation of Liability & Disclaimer of Warranties
DOC-03 · §9 LIABILITYProducts are provided “as is” for the research use described in Research Use Only & Regulatory Disclaimer. Except for the specification stated on a product’s listing and any linked Certificate of Analysis, Tyde makes no warranty, express or implied, regarding any product, including any implied warranty of merchantability or fitness for a particular purpose beyond the stated specification.
To the fullest extent permitted by law, Tyde is not liable for any use of a product outside the research use it is sold for, and you agree to indemnify Tyde against any claim arising from a use inconsistent with Eligibility, Age & Researcher Attestation or Research Use Only & Regulatory Disclaimer. Nothing in this section limits liability for Tyde’s own defective or misdescribed products under Returns, Refunds & Order Issues, or any liability that cannot be limited or excluded under applicable law.
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles, and any dispute will be resolved in the state or federal courts located in New Jersey. Nothing here deprives you of the protection of any mandatory consumer-protection law of the state where you live.
Time limit on claims
Any claim arising out of an order must be brought within one year of the date the order was placed, except where a longer period is required by applicable law.
Changes to These Policies
DOC-03 · §10 CHANGESTyde may update these policies as the business, catalog, and applicable law evolve. The version in effect at the time you place an order governs that order. Material changes will be reflected by an updated date at the top of this page.
Contact
DOC-03 · §11 CONTACTQuestions about an order, a product, or any policy on this page can be sent to support@tydelab.com. Privacy requests — access, correction, deletion, or opting out of marketing — can be sent to privacy@tydelab.com, or to the support address if that’s easier; both reach us.
